IN NO EVENT SHALL LUGNEWS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO LUGNEWS, IF ANY, IN THE TWELVE MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, LugNews's liability will be limited to the greatest extent permitted by law.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and the parties irrevocably consent to the personal jurisdiction and venue therein. You waive any objection to venue in such courts and any claim that such courts are an inconvenient forum.

If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
